Changing Solicitors During An Accident Claim

It is important to ensure that your solicitor is an expert in the issues relevant to motorcycle accidents, both liability and the injuries sustained by bikers.

If you are not happy with your current solicitors or just want to switch to an expert in the field, then it is your legal right to do so.

Changing solicitors is simple – just get in touch and we will ask for some details from you which will enable us to draft a form of authority for you to sign. That form instructs your current firm of solicitors to release the file of papers to us for future conduct of the claim.

Switch to the expert bike lawyers and let us maximise your compensation.

Mr John Cross changed solicitors to Bikelawyer following life changing catastrophic injuries – here is what he had to say after we settled his case:

“Thank you for all your hard work and expertise, this clearly showed with the final result.

We are positive that we wouldn’t have had this out come with the original firm of solicitors. Please pass on our thanks to all of your team and continue to do a splendid job of representing the motorcyclists of this country.

I hope that I and no one I know require such services again, but if anyone does I shall not hesitate in recommending you.”

Why choose Bikelawyer when changing solicitors during a motorcycle accident claim?

Extensive specialist experience with motorcycle accident claims

For over sixteen years, legal partner Andrew Campbell has been supporting clients dealing with the aftermath of motorcycle accidents. Having secured compensation for a biker friend who tragically sustained a life changing head injury as a result of a diesel spill accident, Andrew founded Bikelawyer to help other people in similar situations.

As dedicated specialists in these types of complex claims, we can offer the very best service and specific expertise for even the more challenging situations.

Close, personal service from start to finish

Your claim is important, which is something every member of our team respects. We will work closely with you through every stage of your claim, making sure we explain everything you need to know and always being available to answer your questions.

A reputation for excellence

We are recognised as a leading UK specialist motorcycle accident firm. Every member of our team is an expert lawyer and we have earned a fantastic reputation in the legal industry and beyond over the years, including acting as Motorcycle News (MCN) legal experts and columnists.

Outstanding results for our clients

In the past, we have frequently been able to secure higher levels of compensation for motorcycle injuries in comparison to other firms. This includes in situations where clients have started a claim with another firm before choosing to change personal injury solicitors to Bikelawyer.

As a firm, we have acted in numerous cases where we were able to secure compensation in excess of £1million for our clients. We have also had success with claims that other firms have rejected or where other solicitors were unable to secure suitable compensation for a client.

No win no fee funding

To ensure that our legal expertise is available to as many people as possible, we represent our clients on a no win, no fee basis. This means you do not need to pay us anything upfront to start a claim and you will only need to pay our fees if we succeed in securing compensation for you. I.

When you contact us, our team will carry out a free claim evaluation to determine if your case is suitable for no win no fee funding. We can then explain exactly how this works and your options.

Please note: no win, no fee funding will normally still be available even when changing motorcycle accident solicitor to Bikelawyer from another firm.

Frequently asked questions about changing solicitors during a motorcycle accident claim

What do I do if I am not happy with my solicitor?

If you have been working with a solicitor to pursue a motorcycle accident claim and you are unhappy with their service and/or the outcome they have achieved, you have the right to take your case to a different solicitor.

A new solicitor will be able to give you an independent second opinion on whether they believe your case has been handled correctly and if they feel they can potentially secure a better result for you.

If you decide to switch solicitors, your new solicitor would then contact your existing solicitor to let them know you are changing representation and work out the legal details. Your new solicitor can then take over your case for you.

If you want a second opinion on your claim or are thinking about changing solicitors, then our expert motorcycle accident solicitors will be very happy to advise you.

If you are really unhappy with how your original solicitor handled your case, then you may want to consider making a complaint. In the first instance, you would need to follow the firm’s complaints process, to give them a chance to remedy the issue. If you are not satisfied with the outcome, you can then refer your case to the Legal Ombudsman for support. You could also potentially report the solicitor to the Solicitors Regulation Authority (SRA) if you believe the solicitor has breached the SRA Code of Conduct.

Can you change solicitors halfway through an accident claim?

Yes, you can change solicitors during a motorcycle accident claim at any stage of the claims process, up until you accept a settlement or one is awarded in court.

If you have accepted a settlement or one has been awarded by a court, then it may still be worth getting a second opinion from another solicitor, but it is generally better to contact a new solicitor about getting them to take over your case at an earlier stage of the process.

What happens when you change solicitors?

If you have chosen to change solicitors during a motorcycle accident claim, then your new solicitors will take over your case and contact your old solicitors for you. They will let them know they are taking over the claim (if you have not already informed your old solicitors yourself) and request any files related to your case, so they have all of the relevant information available to them.

One area of concern when changing solicitors may be where your previous solicitors were acting under a no win, no fee agreement. In this scenario, your new solicitors will give your previous solicitors a legal promise to put their fees on hold until the end of the case, at which point their fees would be recovered alongside those of your new solicitors. This is something our motorbike accident claims solicitors will be happy to discuss with your previous lawyers at the point of handover.

How long does a solicitor transfer take?

Changing solicitors during a claim can generally be done relatively quickly, typically in a matter of days or a few weeks, but this will depend on the circumstances, including how prompt your previous lawyers are in responding to any requests from your new solicitors.

If you are worried about how long the process of changing solicitors will take, our team will be happy to discuss this with you when you get in touch.
