On 31 August 2011, James, who was a chef prior to the accident, was traveling on the correct side of the road on his motorcycle when the Defendant, Ms Willoughby, who was traveling in the opposite direction, crossed onto his side of the road causing a collision. She was found to be over the alcohol limit at the roadside but passed on further testing at the police station. Nonetheless she was convicted of driving without due care and attention, fined and disqualified from driving for a year.

James and his surgeons made valiant efforts to save his leg but ultimately he opted for amputation below the knee in summer 2012. Prior to the amputation James was offered £100,000 to settle his claim which he was advised to reject. The third party insurer and Bikelawyer arranged a meeting at which the offer of £810,000 ultimately resulted. The issue for James was that at present his prognosis is not yet certain. The medical legal expert instructed by Bikelawyer placed a 25% chance on James requiring a further (above knee) amputation. However, there was therefore a 75% chance that he would remain a below knee amputee and due to the specifics of his case, the offer represented a good one (when balancing the likely figures for each scenario) and one he very reasonably accepted in order to get on with his life.
